The Last Will and Testament of Thomas Canney 1680

In the name of God, Amen, the tenth day of April in the year of our Lord Christ, 1758, I Thomas Canne of Dover in the Province of New Hampshire in New England, yeoman, being something aged and infirm in body but of a sound disposing mind and memory therefore as I conceive it, the fittest time, do make and ordain this to be my last will and testament.

In the first place I humbly recommend my soul to God the father of spirits hoping for his pardoning mercy thro the merits of Jesus Christ and my body to a decent interment at the discretion of my executor hereafter mentioned and as touching my worldly estate my will is that my just debts be first paid my funeral charges defrayed within convenient time after my decease by my executor of this my last will and testament

Secondly, I give and bequeath to my eldest son Thomas Canne ten acres of land more or less where he now dwells. Also, one hundred pounds old Tenor to be paid him by my said executor with which three hundred pounds old tenor more I paid him myself heretofore which sums together is in full of his portion out of my estate.

Item: I give to my daughter, Susanna Hanson, one hundred pounds old tenor to be paid her by my executor in three years after my decease.

Item: I give to my daughter, Martha Meder, one hundred pounds old tenor to be paid her by my executor in three years after my decease in manner aforesaid.

Item: I give to my son, Benjamin Canne, one hundred pounds old tenor to be paid in manner aforesaid, which sum together with what I have already given him complete his portion.

Item: I give to my daughter, Rose Canne one hundred pounds old tenor to be paid by my executor, also one feather bed and furniture for the same also one iron pot, one iron skillet, one frying pan, and one pewter platter, together with free and full liberty of one room in my house to dwell in and also to have an equal share or comfortable support out of my real and personal estate so long as she shall remain single and unmarried.

Item: I give to my son William Canne, one hundred pounds old tenor to be paid him by my executor, in manner and term aforesaid with what I have already given him complete his portion.

Item: I give to my son John Canne, all my homestead farm where I now dwell (?) a small orchard with the land whereon it stands joyning to Ephraim Tibbets land. I likewise give to my said son John Canne all edifices, buildings, and other orchards thereon together with all that tract or tracts of land of mine on the westerly side of the Back River also one in the ox pasture (so called) together with one piece of thatch bed at or near partridge point, also one feather bed and furniture for the same together with all my farming utensils viz.; plows, harrows cart and wheels sleds, yokes, chains, axes, and with all the iron in or about my house, except what I have already given my daughter Rose Canne to be to him the said John Canne and his heirs and assigns forever he and they carefully complying with and paying out the above-mentioned debts and legacies

Item: I give my grandson Joseph Canne, the within mentioned small orchard with the land whereon it stands. Joining to the land which formerly belonged to Joseph Hall, deceased, also to the land of Ephraim Tibbets aforesaid and I desire that my son, Benjamin Canne may have the care and management of the same aforesaid grandson until he is twenty-one years of age.

Item: I constitute and appoint my son, John Canne, sole executor of this my last will and testament making null and void all and every will or wills heretofore made by me. Rectifying and confirming this and no other to be my last will and testament.

In witness hereof I hereunto let my hand and seal the year and day first above written.

Signed, sealed, published, pronounced and declared by the said Thomas Canne as his last will and testament in the presence of us the subscribers

In witness whereof, I have also hereunto to set my hand and seal in the presence of Elijah Tuttle, Signed: Nathaniel Austin, Alexander Caldwell. N.B. the words all equal was entered before signing

Province of New Hampshire: To all people to whom these presents shall come Richard Wibird, Esquire, Judge of the probate of wills in and for the Province of New Hampshire, sendeth greeting.

Know ye that on the day of the date hereof before me at Portsmouth in said province the instrument’ a copy of which is hereunto annexed purporting the last will and testament of Thomas Canne late of Dover in same province, deceased)  was presented for probate by John Canne, sole executor. Therein named and Alexander Caldwell and Elijah Tuttle two of the witnesses whose names are thereto subscribed being then present made solemn oath that they saw the said testator, sign, seal, and heard him declare the said instrument to be his last will and testament. That he was then, to the best of their judgment of sound and disposing mind and that they with Nathaniel Austin subscribed their names together as witnesses to the execution thereof in the presence of the said testator. I do therefore prove, approve, and allow of the said instrument as the last will and testament of the deceased and do hereby commit the administration thereof in all matters the same concerning and of his estate whereof he died, seized and possessed in said province unto him the aforesaid executor, well and faithfully to execute the said will and testament, and to administer the estate of the said deceased, according to the same who accepted of the said trust and is directed to bring in an inventory thereof according to law and he shall render an account  (upon oath) of his proceedings therein when lawfully thereto required.

In testimony whereof, I have hereunto set my hand and seal of the court of Probate for said province. Dated at Portsmouth aforesaid 30th day of June Anno Domini 1762.

Note: This marriage is listed on Family Search and has a source. However, I'm not convinced he married this woman at age 70. It needs more research. There are two children listed with similar names, but different birth/death dates. They are both listed as born in 1765 - now that would have been an ideal time for Stephen and Comfort to get married. If they were not married until 1809, Comfort would have been nearly 70 as well - beyond the age of a woman being able to give birth.

Part of Charles Probate - according to this letter, he and Comfort lived
with James Griffen and his wife. With that said, the death record the doctor turned in claims that Charles died in the Poor House and his widow, Comfort, lives with them.




Letter petitioning court to have the pension Charles was receiving
go to his widow, who is living with James Griffen and his wife.
The Court was satisfied that this was the case and ordered it to be so.
Though, this is odd since a doctor claimed he died at the poor house (alms house).
Comfort shows up in the 1860 US  Compiled Census and Census Substitutes Index
